10-Day Letter Following No Response to a Notice

This type of letter is required when you have served an adjoining owner with a valid Party Wall notice, they have not responded within 14 days, and a deemed dispute has therefore arisen under the Party Wall Act. It is sent to give the adjoining owner a final 10-day opportunity to appoint their own surveyor before you lawfully appoint one on their behalf under Section 10(4).

Special Foundation Consent

This agreement is required when you propose to construct special foundations (such as reinforced concrete) that extend beneath a party wall or party fence wall. In this circumstance, the Party Wall etc. Act 1996 requires the adjoining owner’s explicit written consent, which cannot be authorised by a surveyor or imposed by an award.

Consent to Build Across the Boundary:

This document is required when you propose to construct a new wall astride the boundary line (the line of junction) and the adjoining owner agrees to give written consent under section 1(3) of the Party Wall etc. Act 1996, rather than dissent and appoint surveyors.

Notice of Access

This notice is required when you need lawful access onto an adjoining owner’s land to carry out works permitted by the Party Wall etc. Act 1996, such as inspection or construction, and must give advance notice before exercising that right under section 8.

Response to Inadequate Security for Expenses Request

This letter is used when an adjoining owner has requested security for expenses under the Party Wall etc. Act 1996, and you wish to seek proper justification and evidence for that request before agreeing.

Request for Surveyor to Resign - Loss of confidence

This document may be used when you believe your appointed surveyor is not acting competently, impartially, or in accordance with their duties under the Party Wall etc. Act 1996, and are therefore requesting that the surveyor voluntarily step aside so a replacement can be appointed.

Request for Surveyor to Resign – Conflict of Interest

This document may be required when you believe your appointed surveyor has a conflict of interest that undermines their independence, contrary to professional obligations (such as RICS guidance), and are therefore requesting resignation so a replacement can be appointed under the Party Wall etc. Act 1996.
